Terms of Service — AsiaFlare

These Terms and Conditions (“Terms”) govern your access to and use of the AsiaFlare mobile application and website (the “Service”) operated by AsiaFlare (“we”, “us”, “our”). By downloading, installing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use AsiaFlare. By creating an account you represent and warrant that:

You are 18 years of age or older.
You are legally permitted to use online dating services in your jurisdiction.
You have not been previously banned from AsiaFlare or any related service.
You will not use the Service for any unlawful or prohibited purpose.

2. Account registration

To access most features you must create an account. You agree to:

Provide accurate, current and complete information during registration.
Keep your account credentials confidential and not share them with anyone.
Notify us immediately if you suspect unauthorised access to your account.
Be solely responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

3. User conduct

You agree not to use the Service to:

Harass, abuse, stalk, threaten or harm any other user.
Post content that is illegal, obscene, defamatory, hateful or discriminatory.
Impersonate any person or misrepresent your identity or affiliation.
Share another person's private information without their consent.
Send unsolicited bulk messages (spam) or engage in commercial solicitation.
Upload malware, viruses or any code intended to damage the Service.
Scrape, copy or redistribute any part of the Service without our express written permission.
Facilitate or promote prostitution, human trafficking or any illegal activity.
Access the Service using automated means (bots, scrapers) without authorisation.

4. User content

You retain ownership of any content you post on AsiaFlare (“User Content”). By posting User Content you grant us a non-exclusive, royalty-free, worldwide, sublicensable licence to use, store, display and distribute your content for the purpose of operating and improving the Service.

You represent that your User Content does not infringe any third-party intellectual property rights and complies with these Terms and our Community Guidelines. We may remove any User Content that violates these Terms at our sole discretion, without notice.

5. Subscriptions and payments

AsiaFlare offers free and premium tiers. Premium features (including Globalist and Incognito) require a paid subscription.

Subscription fees are charged in advance on a recurring basis (monthly or annually, as selected).
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
You may manage and cancel your subscription through your App Store or Google Play account settings.
Refunds are governed by Apple App Store or Google Play refund policies.
Priority Messages are purchased as credits and are non-refundable once used.

6. Intellectual property

All content, features and functionality of the Service — including the AsiaFlare name, logo, design, software and trademarks — are owned by or licensed to AsiaFlare and protected by copyright, trademark and other intellectual property laws. You may not use our intellectual property without our prior written consent.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components. We are not responsible for the conduct of any user on or off the platform.

AsiaFlare is a platform that connects people. We do not conduct background checks on users and make no representations about the accuracy of user-provided information. You are solely responsible for your interactions with other users.

9. Limitation of liability

To the maximum extent permitted by applicable law, AsiaFlare and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages — including loss of data, revenue or goodwill — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.

10. Indemnification

You agree to defend, indemnify and hold harmless AsiaFlare and its affiliates, officers, agents and employees from any claims, damages, liabilities, costs and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

12. Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which AsiaFlare is incorporated, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.

13. Changes to these Terms

We may modify these Terms at any time. We will notify you of material changes via the app or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
